moddoMOUSE Beta Tester Terms & Conditions

These Terms & Conditions (“Terms”) govern your participation in the moddoMOUSE Beta Tester Program (“Program”) operated by Moddo Inc. (“Moddo”, “we”, “our”, “us”). By purchasing, receiving, assembling, or using a moddoMOUSE Beta Tester Kit (“Beta Kit”), you agree to these Terms.

1. Purpose of the Program

The Beta Kit is provided solely for testing, evaluation, and feedback. It is not a final consumer product, may contain defects, and may change before official release.

2. No Warranty (Hardware/Software)

Beta Kits are experimental prototypes and are provided “AS IS” with no express or implied warranties, including but not limited to:

  • Fitness for a particular purpose,
  • Durability,
  • Reliability, or
  • Safety in all conditions.

You acknowledge that hardware or firmware may malfunction, degrade, or fail.

3. Limited Replacement of Faulty PCBs

Moddo will provide a replacement (or refund) for Beta Kit PCBs only if:

  • The PCB arrives dead-on-arrival (DOA) or
  • The PCB has manufacturing defects before you assemble or modify it.

This does not include units damaged by soldering, assembly, mechanical modification, misuse, or improper handling. You must notify Moddo within 7 days of delivery and provide reasonable proof (photos, video, logs).

4. No Liability for Damage During Assembly or Use

Because the Beta Kit requires soldering, assembly, and integration with 3D-printed or custom parts:

  • Moddo is not responsible for any PCB failure, physical damage, firmware issues, overheating, or malfunction that occurs during assembly, modification, or usage,
  • Moddo does not cover any damage caused to your equipment, computer, 3D printer, peripherals, or environment through misuse or improper assembly of the Beta Kit.

You assume all risks associated with assembly and testing.

5. Software and Firmware License

You receive a revocable, personal, non-transferable, license-free right to use the moddoMOUSE firmware and moddoHUB software only for testing the Beta Kit.

You may not:

  • Decompile, reverse-engineer, or redistribute the firmware/software;
  • Reuse firmware/software for commercial purposes;
  • Sell products using Moddo firmware or firmware derivatives without written permission.

6. Feedback & Reporting

By participating, you agree to:

  • Provide reasonable feedback, bug reports, and observations through channels designated by Moddo (moddoHUB bug reporter, GitHub Issues, email, etc.),
  • Allow Moddo to use your feedback freely for improvements, including reproduction of issues.

All feedback becomes the property of Moddo Inc.

7. No Obligation to Implement Feedback

Moddo is not obligated to implement suggestions or feature requests and may discontinue the Program at any time.

8. Safety Acknowledgement

Beta Kits may include:

  • High-current circuits,
  • LiPo batteries,
  • Sharp PCB edges,
  • Experimental firmware, and
  • Hardware tolerances outside final production specs.

You agree to use the device responsibly and at your own risk, and only in safe environments.

9. Public Content / Online Posts

You are free to post videos, reviews, or discussions about the Beta Kit unless explicitly provided a private NDA version. Moddo may repost or reference your content with credit. If this is a private early tester group, Moddo may require:

  • No publishing of teardown photos,
  • No benchmarking against competitors, or
  • No disclosure of internal details.

10. Limitation of Liability

To the maximum extent permitted by law, Moddo Inc. is not liable for:

  • Loss of data,
  • Damage to property,
  • Injuries,
  • Indirect, incidental, or consequential damages,
  • Business losses,

Arising from use or inability to use the Beta Kit. Your sole remedy is the limited replacement/refund described in Section 3.

11. Changes to Terms

Moddo may update these Terms at any time. Changes become effective immediately upon posting.

12. Governing Law

These Terms are governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
