moddoMOUSE App Terms of Use

These Terms of Service (“Terms”) apply to your use of the moddoHUB Web App, moddoHUB Desktop App, and all related device-configuration tools, cloud features, firmware updates, and services offered by MODDO INC. (“moddo”, “we”, “our”, or “us”).
Collectively, these offerings are referred to as the “Services.”
By creating an account, downloading the app, or connecting a moddo device (such as moddoMOUSE or future moddo products) to the Services, you acknowledge these Terms and agree to be bound by them from the date you first use the Services (“Effective Date”).
Some Services may require you to accept additional product-specific terms. If any additional terms conflict with these Terms, the additional terms will take precedence for that specific feature.
1. Overview of the Services
moddoHUB allows you to configure and manage compatible moddo hardware, including:
- Device performance settings (polling rate, DPI, latency modes),
- Macros, key bindings, and custom input behaviors,
- Lighting, power, and advanced sensor configurations,
- Firmware updates,
- Optional cloud-syncing of profiles,
- Experimental or beta features (when enabled).
We may enhance, extend, limit, or discontinue features over time. The functionality available to you may vary depending on your device model, hardware revision, region, or account type.
2. Eligibility & Account Requirements
Some Services require a moddo Account. By creating an account, you agree that:
- You will provide accurate and truthful information.
- You will keep your credentials confidential and secure.
- You will be responsible for all actions taken under your account.
- You will notify us immediately of unauthorized use or a security incident.
You may not sell, lease, or transfer your moddo Account to another person.
The Services are not intended for users under 16 years of age, and we do not knowingly collect personal data from children under 16.
3. Acceptable Use
You agree not to misuse or interfere with the Services. This includes, but is not limited to:
- Modifying or attempting to access device firmware in unauthorized ways,
- Reverse engineering device communication protocols,
- Bypassing security, authentication, or access-control systems
- Attempting to overload, disrupt, or degrade the Services,
- Distributing malware or harmful code through the Services,
- Scraping, crawling, or automating access without permission,
- Violating applicable laws or third-party intellectual-property rights.
Use of the Services does not grant you ownership of any software, UI elements, brands, documentation, or underlying IP belonging to moddo.
4. Software & Firmware
To use moddo devices, you may be required to download software or device firmware (“moddo Software”).
You acknowledge that:
- moddo Software may receive updates, patches, or compatibility improvements.
- Some updates may be essential for device stability, security, or functionality.
- Certain components may be governed by open-source licenses.
- You may not alter or distribute moddo Software unless a license explicitly allows it.
Beta firmware or pre-release features may cause instability or data loss. You use these optional features entirely at your own risk.
5. Data Handling & Privacy
Your use of the Services is subject to the moddo Privacy Policy, which explains:
- What information we collect,
- How it is used to improve device performance and user experience,
- How configuration profiles may be stored locally or in the cloud,
- How you may request access or deletion of your data.
Examples of data the Services may process include:
- Device configuration (DPI levels, polling rate, and macros),
- Firmware version and hardware identifiers,
- Diagnostic logs or crash reports (optional),
- Cloud-sync settings (if enabled by you).
Analytics and anonymous diagnostic data are optional and disabled by default unless you opt in. We may process your data outside your country of residence using secure transfer mechanisms.
6. User Content & Custom Profiles
Some features allow you to create or upload content (“User Content”), such as:
- Macros,
- Icons, images, or custom assets,
- Device profiles,
- Per-game or per-application settings.
You retain ownership of your User Content. However, to operate the Services, you grant moddo a worldwide, non-exclusive, royalty-free license to store, process, adapt, and display User Content within the Services (e.g., syncing profiles across devices).
This license ends when all copies of your User Content are deleted from our systems, except where required for operational logging or backups, which expire automatically.
7. Third-Party Features & Integrations
The Services may include tools, modules, or content provided by third parties, including:
- Analytics tools,
- Game-specific integrations,
- Shared community presets,
- Device libraries or open-source components.
moddo is not responsible for third-party content and does not guarantee its accuracy or safety. Your interaction with third-party features is at your own discretion.
8. Changes to the Services
We may:
- Add new features,
- Remove features,
- Revise functionality,
- Restrict certain activities,
- Impose future service fees,
- Discontinue the Services entirely.
When possible, we will provide advance notice of significant changes. If you do not agree with a change, your remedy is to discontinue use of the Services.
9. Security
We implement industry-standard measures to protect account data and device communication. However, no online platform is perfectly secure.
You acknowledge and agree that:
- You use the Services at your own risk,
- Uninterrupted or error-free operation is not guaranteed,
- No system is immune to unauthorized access.
You are responsible for maintaining the security of your devices, operating system, and network.
10. Warranty Disclaimer
To the fullest extent allowed by law, the Services are provided “as is” and “as available.”
We disclaim all warranties; express, implied, or statutory including:
- Merchantability,
- Fitness for a particular purpose,
- Accuracy or reliability,
- Non-infringement,
- Uninterrupted access.
Some jurisdictions may limit these disclaimers; where required, we apply the minimum legally necessary warranties.
11. Limitation of Liability
To the maximum extent permitted by law, moddo will not be liable for:
- Lost data, corrupted profiles, or configuration errors,
- Indirect, incidental, consequential, special, or punitive damages,
- Business interruption, lost profits, or loss of use,
- Firmware-related issues arising from beta or experimental features.
If your jurisdiction restricts such limitations, our total liability will not exceed the amount you paid for the affected moddo product or CAD $50, whichever is greater.
Your exclusive remedy for dissatisfaction with the Services is to stop using them
12. Your Responsibility & Indemnification
You agree to indemnify and hold moddo harmless from claims, losses, damages, or costs arising from:
- Your violation of these Terms,
- Your misuse of the Services,
- Your infringement of third-party rights,
- Your User Content.
We may, at our discretion, assume control of any matter subject to indemnification.
13. Changes to These Terms
We may revise these Terms from time to time. The revised version will be posted with an updated effective date.
Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
If you do not agree, you must stop using the Services.
14. Governing Law
These Terms are governed by the laws of Ontario, Canada, excluding conflict-of-law rules.
15. Dispute Resolution
Except where prohibited, disputes related to these Terms or the Services will be resolved through binding arbitration in Toronto, Ontario, conducted in English before a single arbitrator.
Class actions, class arbitration, or representative claims are not permitted.
If your jurisdiction does not allow mandatory arbitration, disputes may be brought in your local court.
16. Miscellaneous
- If any part of these Terms is held invalid, the remainder remains enforceable.
- These Terms constitute the entire agreement between you and moddo regarding the Services.
- Failure to enforce any provision is not a waiver of rights.
- Sections that logically must survive termination will continue to apply.
